These Terms and Conditions set out the basis on which we provide waste collection services in West Kensington and surrounding areas. By booking any service with us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Service means any waste collection, removal, clearance, recycling, or related activity that we agree to carry out for you.

We, us, our means the waste collection service provider operating in West Kensington under whose name the booking is made and the invoice is issued.

You, your means the customer who requests and/or receives the Service, whether as an individual, business, landlord, managing agent, tenant, homeowner, or other party.

We reserve the right to refuse any waste collection if, in our reasonable opinion, the waste is hazardous, illegal, improperly described, unsafe to handle, or beyond the scope of our licensing or capabilities. In such cases, we will inform you of the reasons for refusal and, where possible, discuss alternative solutions.

3. Booking Process

3.2 Based on the information you provide, we may give you an estimated price or a price range. The final price will be confirmed upon our team’s arrival, once we have assessed the actual waste volume, access conditions, and any additional work required.

3.3 A booking is only confirmed when we accept your request and provide a date and time (or time window) for the Service. We reserve the right to decline any booking at our discretion.

4. Service Times and Access

4.1 We will use reasonable efforts to attend your property on the agreed date and within the agreed time window. However, all arrival times are estimates and may be subject to delay due to traffic, weather, vehicle breakdown, staff illness, or other circumstances beyond our reasonable control.

4.2 You are responsible for ensuring that we have safe, lawful, and reasonable access to the property and to the waste to be collected. This includes arranging any permits, parking provisions, keys, codes, or authorisations needed to enter the premises or use nearby parking facilities.

4.3 If we are unable to carry out all or part of the Service due to lack of access, unsafe conditions, incorrect address, or other issues within your control, we may charge a call-out, waiting, or cancellation fee as set out in these Terms.

5. Customer Obligations

5.1 You warrant that you either own the waste to be collected or have the permission of the owner to dispose of it.

5.2 You agree to provide accurate information about the waste, including any hazardous or restricted items, and not to conceal dangerous materials among general waste.

5.3 You must ensure that the waste is reasonably accessible and not obstructed by locked gates, parked vehicles, or other barriers, unless we have agreed to manage these arrangements as part of the Service.

5.4 You agree to comply with all relevant laws and regulations relating to waste, health and safety, and property access, and to cooperate with our staff so that they can carry out the Service safely and efficiently.

6. Payments and Charges

6.1 Unless we agree otherwise, payment is due in full upon completion of the Service and before our team leaves the site. We may accept cash, card payments, bank transfers, or other methods as notified to you from time to time.

6.2 For business customers or larger jobs, we may issue an invoice with specified payment terms. Late payment may incur interest and administration charges in accordance with applicable UK law.

6.3 Our prices are generally based on the volume and nature of the waste, the labour involved, access conditions, and any disposal or regulatory surcharges. We will explain the pricing structure in advance wherever possible.

6.4 All prices are exclusive of any applicable taxes unless specifically stated otherwise. If VAT or any similar tax is chargeable, it will be added to the price and shown separately on the invoice or receipt.

6.5 If additional work is required on site that was not specified at the time of booking, such as extra waste, difficult access, or dismantling of items, we will discuss any revised charges with you before proceeding.

7. Cancellations, Changes, and No-Show

7.1 You may cancel or amend your booking by giving us reasonable notice prior to the scheduled arrival time. Where possible, we request at least 24 hours notice for standard waste collection bookings.

7.2 If you cancel with less than 24 hours notice, or if we arrive on site and are unable to carry out the Service due to reasons within your control (including no access or no authorised person present where required), we may charge a cancellation or call-out fee to cover our costs.

7.3 We reserve the right to cancel or reschedule the Service if events occur that are beyond our reasonable control, including severe weather, accidents, staff shortages, or legal constraints. In such cases, we will contact you as soon as reasonably practicable to arrange an alternative date and time.

8. Waste Types, Exclusions, and Regulations

8.1 We operate in accordance with applicable UK waste management legislation and regulations. We are committed to lawful and responsible disposal and recycling of waste collected from West Kensington and surrounding areas.

8.2 Certain items are classified as hazardous or subject to special controls, including but not limited to asbestos, chemicals, solvents, oils, clinical waste, gas cylinders, certain electrical items, and some construction materials. We may not be licensed or equipped to handle such items and therefore may refuse to collect them or may require separate arrangements and pricing.

8.3 You agree not to present for collection any waste that is illegal to transport, store, or dispose of, or which you do not have the right to discard. If such items are discovered among your waste, we may refuse to remove them, charge additional fees, or require you to remove them from the load.

8.4 Once we have collected your waste, ownership of that waste transfers to us or to the licensed carrier we appoint. We will then handle transport, recycling, recovery, or disposal in accordance with applicable law and our environmental policies.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing our waste collection services. However, our liability to you is limited as set out in this section.

9.2 We will not be liable for any indirect, consequential, or purely economic losses arising out of or in connection with the Service, including but not limited to loss of profits, loss of contracts, loss of goodwill, or loss of anticipated savings.

9.3 Our total liability for any direct loss or damage arising from our performance or failure to perform the Service, whether in contract, tort (including negligence), or otherwise, shall be limited to the total price paid or payable for the specific Service giving rise to the claim, except where such limitation is not permitted by law.

9.4 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under UK law.

9.5 You are responsible for removing or securing any fragile, valuable, or delicate items that may be at risk during the collection process. Where we are required to move items to gain access to waste, we will take reasonable care, but we will not be liable for minor cosmetic damage or wear and tear.

10. Insurance and Risk

10.1 We maintain appropriate insurance cover for our operations, including public liability insurance, in line with industry standards for waste collection services.

10.2 Risk in the waste passes to us at the moment it is loaded onto our vehicle. Until that point, the waste remains your responsibility.

11. Health, Safety, and Site Conditions

11.1 We reserve the right to refuse or suspend the Service if, in our reasonable opinion, the conditions at the property present a health or safety risk to our staff or the public.

11.2 You must inform us of any known hazards at the property, including structural issues, contamination, sharps, dangerous animals, or other conditions that may affect the safe completion of the Service.

11.3 Our staff will follow health and safety procedures, including the use of protective equipment where appropriate. You agree not to interfere with or obstruct our staff while they are carrying out their work.

12. Complaints and Disputes

12.1 If you are dissatisfied with any aspect of the Service, you should notify us as soon as reasonably practicable, preferably within 48 hours of completion, so that we have an opportunity to investigate and address your concerns.

12.2 We will review your complaint and may request supporting information or photographs. Where we consider that a service issue has occurred, we will work with you to agree on an appropriate remedy, which may include a partial refund, a re-visit, or other reasonable resolution.

13. Data Protection and Privacy

13.1 We will collect and use your personal information only to the extent necessary to carry out the Service, manage bookings, process payments, and handle queries or complaints.

13.2 Your details may be stored securely and used for administrative and accounting purposes in accordance with applicable UK data protection legislation.

14. Amendments to These Terms

14.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that particular Service.

14.2 Updated Terms may be made available on our website or provided to you upon request. Continued use of our services after changes take effect will be treated as your acceptance of the revised Terms.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or relating to these Terms or the provision of our waste collection services.

16. General Provisions

16.1 If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed removed, but the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy under these Terms shall be construed as a waiver of that right or remedy, nor shall any single or partial exercise of any such right or remedy prevent any further or other exercise of it.

16.3 You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary for the operation of our waste collection services.

16.4 These Terms and Conditions, together with any written quotation or confirmation we provide, constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings or representations, whether oral or written.
